When to File a Complaint

You should file a complaint with OSHA if you believe there is a serious hazard on your worksite or your employer is not following OSHA standards. Examples include:

  • Missing fall protection on high surfaces
  • Trenches without proper shoring or sloping
  • Damaged electrical equipment
  • Lack of required personal protective equipment
  • No training for dangerous equipment

Your Protection Against Retaliation

It's illegal for employers to fire, demote, transfer, or discriminate against workers for filing OSHA complaints. If you experience retaliation, you must file a whistleblower complaint within 30 days.

How to File a Complaint

Option 1: Online

  1. Visit OSHA's website at www.osha.gov/workers/file-complaint
  2. Complete the online form with details about the hazard
  3. Include your contact information (can be kept confidential)
  4. Submit the form

Option 2: By Phone

  1. Call 1-800-321-OSHA (6742)
  2. Explain the hazard to the OSHA representative
  3. Provide the name and address of your worksite

Option 3: In Writing

  1. Download the complaint form from OSHA's website
  2. Fill it out completely, being as specific as possible
  3. Mail or fax to your local OSHA office

What to Include in Your Complaint

  • Your name, address, and phone number (request confidentiality if needed)
  • Employer name, address, phone number, and type of business
  • Worksite location if different from business address
  • Names of managers or supervisors
  • Description of the hazard - be specific about the danger
  • Number of workers exposed and how often
  • Whether workers have complained to the employer
  • Any injuries or illnesses related to the hazard

What Happens Next

  1. For serious hazards, OSHA may conduct an on-site inspection
  2. For other hazards, OSHA may call your employer
  3. If violations are found, OSHA may issue citations and fines
  4. You can ask for the results of the inspection
